Our services at Stewart Wayne Elder Law PC are comprehensive, addressing the key legal areas that impact seniors and their families. We offer expert assistance in:

  • Estate Planning: This fundamental service involves creating a roadmap for the future, ensuring your assets are protected and your wishes are honored. We help you with the preparation of essential documents such as wills, trusts (including living trusts, special needs trusts, and more), powers of attorney (both financial and medical), and advance directives for healthcare. Proper estate planning can help minimize taxes, avoid probate, and provide for your loved ones according to your specific instructions.
  • Medicaid Planning: Navigating the complex rules of Medicaid eligibility for long-term care can be daunting. Our attorneys provide guidance on how to legally and ethically protect your assets while ensuring you or your loved one can qualify for necessary medical assistance. This may involve strategic asset transfers, the creation of specific trusts, and careful consideration of income and asset limitations.
  • Guardianships and Conservatorships: When an individual becomes incapacitated and can no longer manage their own financial affairs or make healthcare decisions, the court may appoint a guardian or conservator. We assist families in understanding this process, petitioning the court when necessary, and ensuring that the rights and best interests of the incapacitated individual are protected.
  • Estate and Trust Administration: After the passing of a loved one, the process of administering their estate or trust can be complex and time-consuming. We provide expert legal guidance to executors and trustees, helping them navigate probate court, manage assets, pay debts and taxes, and ultimately distribute the inheritance to beneficiaries.
  • Veterans Benefits: We understand the unique needs of veterans and can assist them in understanding and applying for various benefits they may be entitled to, including disability compensation, pension benefits, and healthcare.
  • Long-Term Care Planning: Planning for the costs of long-term care, whether in a nursing home, assisted living facility, or at home, is a critical aspect of elder law. We help clients explore their options, including private insurance, Medicaid, and other resources, to ensure they can afford the care they need without depleting their life savings.

Beware he has already checked out. Wayne is currently (Not for much longer) representing my mother. She has been working with him for a long period of time. Whenever I ask her what is the latest she really has no news or is confused on what is going on. i recently was in Denver and had met with Wayne. I had to leave angry messages on his answering machine just to get an appointment with him. After meeting with Wayne and talking with my mother we had additional questions. I emailed Wayne on 8/16/2017 with several questions that we took away from the previous days meeting. I also called him and left a message letting him know I sent the email. I have not gotten a response to the email or phone call. I have left more phone messages and still no response. The most recent message I left was on 8/28/2017. In my opinion this guy has completely checked out. So you have been warned.

Really took the time to understand what I was looking for, and advised me to take a different approach even though it meant I wouldn't be giving him my business.
