I strongly advise against hiring Emily Smoak as legal counsel. My experience was nothing short of a disaster. Throughout the case, Ms. Smoak relied on unfounded accusations rather than solid legal arguments, demonstrating a complete lack of preparation for the hearing. During the proceedings, when the commissioner instructed her to draft the judgment on-site and obtain signatures before leaving the courthouse, she admitted that she didn’t have her laptop and requested to complete it later. The commissioner was visibly displeased but allowed it. A week later, when the order was finally drafted, it was riddled with errors. Despite multiple requests for updates and corrections, Ms. Smoak’s office failed to provide any response, and the incorrect order was ultimately filed. After reading other reviews, it appears that this level of negligence is standard practice for this firm. If you are looking for an attorney who is prepared, responsive, and capable of handling your case properly, look elsewhere. Do not waste your time and money on representation that lacks both competence and accountability.
I challenge and dispute any claims to the effect of Emily Smoak being anything but ethical, moral, conscientious and caring as a family law attorney. She is an experienced professional who also has a heart and a soul that shines through brightly… she is very thorough and very honest, and sometimes honesty can be difficult to hear if it’s not in alignment with our wishes and our goals. She will always take the available ingredients of a situation and do the absolute best with them. The legal system has many flaws and limitations, it can feel heartless and cruel, and if things don’t go as hoped, it’s very easy to place blame on someone. I speak from experience. My situation prior to engaging Emily felt hopeless, years of epic fails by every level of the system that was supposed to protect good people. Before engaging my previous attorney, DCFS let me down, then into the legal process, so did a guardian ad litem and later a custody evaluator.. it was unfathomable to experience such outcomes with my situation. I had every reason to be angry and want to place blame. The legal system unfortunately, is what it is, I hope it changes for the better… it can feel viscous and heartless, even useless as a way to solve genuine difficult problems. In a family law case, so much we bring to the table gets neutralized in the “he said/she said” abyss. The court only sees and hears what it does… and best attorney in the world can only do what they can do to navigate those ugly waters, despite their best and exhaustive efforts. When we engage a family law attorney, it’s because we have a difficult circumstance we need help solving… so much is beyond their control, so many factors play into the equation… what commissioner and judge gets assigned, how honest and ethical your opponent is and their counsel, the list is endless. Emily Smoak knows the landscape and how to best leverage whatever factors are available at any given point in the process. If things didn’t go your way, I genuinely am sorry. She is honest, ethical, professional, experienced, and wants nothing more than to help you attain your goals. If she wasn’t able to, consider blaming the system… it’s quite flawed and has excruciating limitations.

Filed these documents without fixing the mistakes, then later lied about me publicly to try to hide everything she had done. Was very rude and bullying. Dropped me right before my hearing. I lost my hearing and me and my children have spent years of suffering and over $150,000 in legal fees so far due to her negligence. She should be disbarred.
