One too many red flags for me. After working in an office setting with a multitude of lawyers for several years, I've observed my fair share of character traits of many attorneys. The good the bad and the questionable. I've also personally worked with lawyers with great outcomes. Unfortunately, this one fell into the sour tasting category. First red flag is I had booked an early morning appointment and waited all day just for a no-call no-show. Not even a curtesy email to reschedule. One of my biggest pet peeves is punctuality and time management; especially in a level of professionalism. There is 24 hours in a day and seven days in a week to be mindful. Second red flag, I had specifically re-scheduled a second appointment due to the no-call no-show and made sure it was done in a timely manner due family matters. I still received a call even though I rescheduled for the following day. I don't know if that was a system hiccup overlooked or that the same name being booked back to back didn't question anything. The third was a lack of common etiquette and curtesy. I mean forget the formal introduction. But the straw that broke the camels back was the dismissive tone and fishing method. My third-party inquiry claim was very precise and detailed only for the lawyer to fish for other reasons to consider my case worthy. I mean if you're looking to solely take a case for a specific matter that was seeminly irrelevant to my initial inquiry, time and energy could've been saved. At least me. I was in such disbelief that not only did he fail to commit to a prior appointment, but between the desperate attempts, and the disregard to the actual nature of my claim due to retaliation in a hostile work environment. It was probably in my best interest to look elsewhere. I guess this is when the statement "rejection is protection" stands true because I should have not ignored my initial gut instincts while giving the benefit of doubt.

David Spivak initially took my case with the understanding that they would only collect if awarded any damages. However, Mr. Spivak changed terms after lawsuit was filed saying that I had to pay his law firm their hourly rate because they weren’t confident they could collect because employer hid their assets. Mr. Spivak then proceeded to be very rude and disrespectful, slow to respond to communications.
