Welcome to McClintock Law Firm, your dedicated team of nearby lawyers specializing in Colorado criminal appeals and appellate law. Serving individuals across the state, particularly within the Denver metropolitan area and beyond, we focus exclusively on providing expert legal representation to those seeking to challenge their criminal convictions and navigate the complex appellate process. As specialists within the "Nearby Lawyers" category, McClintock Law Firm offers a unique and crucial service for individuals who believe errors were made in their criminal trials or during post-conviction proceedings.

At McClintock Law Firm, we understand that a criminal conviction can have profound and lasting consequences on an individual's life, liberty, and future. The appellate process offers a critical opportunity to review trial court decisions for legal errors that may have impacted the outcome of a case. Our firm is committed to providing thorough, meticulous, and persuasive appellate advocacy to clients seeking to overturn or modify their convictions or sentences.

Our Environment: Focused and Specialized Legal Expertise

McClintock Law Firm operates as a highly specialized legal practice, concentrating solely on criminal appeals and post-conviction matters in Colorado. This focused approach allows us to develop and maintain a deep understanding of appellate law, rules of procedure, and the intricacies of the Colorado appellate courts. Our environment is one of rigorous legal analysis, meticulous research, and strategic advocacy. We are dedicated to providing our clients with the highest level of expertise in this specific area of law.

We understand that clients seeking appellate representation are often facing significant emotional distress and uncertainty. Our firm strives to provide a supportive and professional environment where clients feel informed, understood, and confident in the legal strategies we pursue on their behalf. While the appellate process differs significantly from trial-level proceedings, our commitment to clear communication and client support remains paramount.

Our Services: Expert Criminal Appeals and Post-Conviction Relief

McClintock Law Firm offers a comprehensive range of services related to Colorado criminal appeals and post-conviction relief, including:

  • Direct Criminal Appeals: Following a criminal conviction, individuals have the right to appeal the trial court's decision to a higher court. Our attorneys handle all aspects of direct appeals, including:
    • Reviewing the trial court record for legal errors.
    • Identifying appealable issues, such as errors in jury instructions, evidentiary rulings, or prosecutorial misconduct.
    • Conducting extensive legal research and writing persuasive appellate briefs.
    • Presenting oral arguments before the Colorado Court of Appeals and the Colorado Supreme Court.
  • Post-Conviction Relief (Rule 35(c) Motions): In cases where direct appeals are unsuccessful or no longer available, post-conviction relief proceedings under Colorado Rule of Criminal Procedure 35(c) provide an avenue to challenge a conviction based on constitutional violations or other fundamental errors that occurred during the trial or sentencing process. We assist clients in preparing and litigating these complex motions.
  • Federal Habeas Corpus Petitions: For clients whose state court appeals and post-conviction efforts have been exhausted, we can assess the possibility of pursuing federal habeas corpus relief in federal court, alleging violations of federal constitutional rights.
  • Sentence Review and Modification: In some circumstances, it may be possible to seek a review or modification of a sentence imposed by the trial court. We can advise clients on their options and represent them in these proceedings.
  • Ineffective Assistance of Counsel Claims: A common basis for appeal or post-conviction relief is the claim that a defendant's trial attorney provided ineffective assistance of counsel, falling below an objective standard of reasonableness and prejudicing the outcome of the case. We have experience in evaluating and litigating such claims.

The attorneys at McClintock Law Firm possess a deep understanding of Colorado criminal law, appellate procedure, and the standards of review applied by appellate courts. They are skilled in identifying legal errors, crafting compelling legal arguments, and presenting those arguments effectively to appellate judges.

I am very disturbed with unethical manner in which my family was "represented " for lack of a better term. I would suggest not paying upfront because then the job is already done with nothing left to work for. Very disheartening for the amount of money and stress. If I would have stayed with this firm I would not be free right now. I had better luck and support from the public defender.

Was trying to get my record sealed and was told that it couldn’t be sealed by the paralegal or whoever answered the phone. I asked to speak with the attorney so I could have a better understanding of why it couldn’t be sealed because the paralegal couldn’t explain, and she wouldn’t even talk to me. She said if I think it can be sealed seek another attorney, she was very unprofessional. Since then I’ve spoken with several other attorneys and all have told me that it CAN be sealed due to recent ligation that was passed earlier this year. So, it doesn’t sound like she’s very good at her job if she doesn’t know the law... Be Advised… or maybe she’s right and the other 8 attorneys are wrong guess only time will tell. The 1 star review is because I felt they could have been more professional an explained to me why she felt it couldn’t be sealed and see if there were other options but instead just blew me off.

Elizabeth was extremely helpful in my case...I only wish she did family law as well, but as a Criminal Defense Attorney you could not get a better advocate and voice to defend you.
