Ms. Burke filed a 2 Million $$ Dental malpractice on my behalf for tx beg 4-30-2003 thru 2-9-12, however, I reminded her that the complaint did not include all of my txs & referred her to the orig copy of DEF's website provided on 5-25-12, which noted a false YR[2003] as to when the DEF's practice 1st opened, includg our bank rxds showing cks written to DEF on 7-25-2002 & 8-28-2002. In May 2013, I presented copies of my prior records to Ms. Burke that showed DEF deliberately w/h 1st 3 tx's for litigation purposes & fraudulntly postd these tx's (8-28-02,9-18-02, 10-2-02) to a new dental chart & slippd the chart into my formr dentist's rxds. DEF also posted husband's 1st tx w/him on 7-25-2002 to that chart & noted recent diabetes diagnosis.. Ms. Burke had the fraudulent rxds 11 mos prior to DEF's depo, & was ethically reqd to addrs & modify my complnt by mid-May 2014 due to statutes (VA Reg. 18.2-260.1); however, DEF's deposition w/out reason was delayed 6 mos which still gave ample time to subpoenaed the record, but she ignored my emails requesting a doc examiner, and never specifically questioned DEF. Thus, DEF was allowed to w/h my 1st 3 tx's & present False interogs. In Sept 2013, I also informd Ms. Burke that the Oral Surgeon assoc w/Def appeared to be concealing evidence, since he failed to provide her w/copy of my 1st consult for Implants in July 2007 & though she pick/up the phone as she was calling someone & assuring me they wud f/up, no report rec'd (nor did surgeon note her recontact when I f/up'd in 10-14. She also failed to depose my witnesses(2 formr employees w/info "material" to my case), she failed to add the false tx info thru-out the DEF's re-written tx notes & compare the notes w/ all of my dental recepts & calendars that I provided, which documented my 30+ emerg visits. She failed to add his false allegs that my total fees wer approx. $43,000 since my receipts& bank records clearly shwd m/than $60,000, she failed to add the DEF's lies regarding his lab prescripts receipts & dental impress (as advised by a frmr employee who was never deposed), & she failed to get copy of flood receipt. She also failed to shift burden to dentist re: lab receipts, failed to specifically address the specific egregious problems identified by my exemplary Dental Expert, Board-Certified Prosthodontist, e.g., no x-rays, no informd consent, no tx plan, etc, She also ignored my entire testimony & emails & they rushed to relese the designation of expert's testimony & egregiously dismissed 1/2 my txs & found defendant fell below the standard of care on one(of many)false tx dates inserted in his notes (1-30-2006);however, my dental expert completely disagreed with these assessments. She failed to review my records & deposition w/me, & essentially dismissed me frm havng input into my lawsuit Ms. Burke also oddly deposed the dentist's "loyal" hygienist who never txd me (but not my witnesses) & repeatdly questiond her re "dry mouth"& meds? Hygienist also testifd that the formr receptionist wud know whether any rxds were dmged by office flood(who ws my witness but nevr deposed).She releasd confide info that shud hav been reviewd w/me prior to it's releas(especially since she promisd in an earlier email [May 2013]that she wud do just that) & includng fact that on 1 specific date it reflects a typo that ws clearly in error & shud hav been immediatly brought to my atten as well as my physicians for correction as subsequently notified to her co-counsel. Moreover, she also relsed info that was confidential re: marriage counselng accomplished by adding husband to interrogs unknowingly at the time for the sole purpose to further humiliate me (despite my earlier email to her on May 2013.).Thus, despite suffering with sx's of PTSD, Major Depression and overall deteriorating well-being for nearly 10 years due to the total destruction of my oral health, which prevented me from actually chewing my foods and engaging in social functions, Ms. Burke & co-counsel outrageously added add'l emotional distress & I was essentially duped again.
